Article 2 — Purpose
The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of Benastra wines. They apply to the exclusion of any other conditions, except with the express prior agreement of the seller.
In accordance with article L. 3342-1 of the Public Health Code, the sale of alcohol to minors is strictly prohibited. By placing an order, the customer declares that they have reached the legal drinking age in their country of residence (18 years in France).
Article 3 — Products
The wines offered for sale come from organic farming, certified by Ecocert. Each product is the subject of a descriptive sheet specifying its essential characteristics (appellation or geographical indication, grape variety(s), vintage, capacity, alcoholic degree).
Photographs and descriptions are provided for illustrative purposes. Labels, vintages and alcohol levels may vary from one delivery to another within the limits of available stocks; the seller undertakes to inform the customer before shipment.
Product availability is indicated on each sheet. In the event of unavailability after ordering, the customer will be refunded in full within 14 days.
Article 4 — Price
Prices are expressed in euros, all taxes included (TTC). They exclude delivery costs, which are detailed in article 6.
Benastra reserves the right to modify its prices at any time. The applicable prices are those displayed at the time of validation of the order.
Article 5 — Orders
The order is placed online using the following process:
- Selection of products and addition to basket;
- Checking the contents of the basket;
- Information of delivery and billing details;
- Choice of delivery method;
- Validation of payment;
- Order confirmation by email.
Any validated and paid order is firm and final subject to the exercise of the right of withdrawal provided for in article 8. The seller reserves the right to cancel any order in the event of suspicion of fraud or obvious error in the price.
The order confirmation constitutes acknowledgment of receipt but not definitive acceptance; this occurs during the shipping of the products.
Article 6 — Delivery
Orders are shipped by carrier specialized in the transport of wines and spirits, with appropriate packaging (individual packing of each bottle).
Delivery areas and fees
- Metropolitan France — order ≥ €200 including tax: free delivery.

Upon receipt, the customer must check the condition of the package in the presence of the delivery person. Any damage (broken bottles, damaged package) must be reported immediately to the carrier by written reservation, then confirmed by e-mail to Benastra within 48 hours of delivery to the address domaine.benastra@gmail.com.

- By email: domaine.benastra@gmail.com
- By mail: Rue de la Fou ZA, Le Réal, 66220 Saint-Paul-de-Fenouillet

The refund will take place within 14 days of receipt of the returned products, by the same means of payment as that used when ordering.
Article 9 — Legal guarantees
The products benefit from the legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
In the event of a non-compliant product or one presenting a defect, the customer must contact Benastra as soon as possible at the address domaine.benastra@gmail.com. An amicable solution (exchange, refund) will be offered.
